Life vs. Abortion

Who Pays for the Services Recieved

Does any one American have the moral and legal rights to live on the labors
and at the expense of other Americans? To be more explicit, should Congress,
through its taxing authority, give the Bank of America, Citibank, Archer Daniels
Midland, farmers, dairymen, college students and poor people the right to live
off of the earnings of another American? I suspect most Americans would agree
with my answer: No one should be forcibly used to serve the purposes of another
American. To force one person to work for and pay the expenses of others is
simply slavery, which is what modern Progressivism and Socialism are all about.
Since the Demwit party has adopted those creeds then that is also what the Dem
Party is all about.

The above begs a moral question, namely under what
conditions is it moral and right to initiate force and threats of force against
a person who himself has not initiated force or threats against another?
Before you answer, you might want a bit more information having an important
bearing on the answer, namely are we talking about a free or a non-free society?
In a free society, there's no moral case that can be made for the initiation of
force against one who hasn't himself initiated force against another. Could be
that's a societal ideal beyond our reach here on Earth. But we can make it legal
whether right or not. After all, we have delegated certain rights to government
to provide certain services, as enumerated in the U.S. Constitution,
particularly as specified in Article I, Section 8 of the document. Each American
is duty-bound to pay his share which is why we pay taxes, namely income
taxes.

A case can be made for the initiation of force against one who
refuses to pay his share of those expenses. That is why we put people in jail
for not paying their income taxes. Well, what ff an American says that he'll pay
his share of those constitutionally mandated functions of the federal government
but refuses to give up his earnings to be used for handouts to the Bank of
America, Citibank, Archer Daniels Midland, farmers, dairymen, college students
and poor people, should some kind of force be initiated against him? That is
what the Tea Party Movement in America was and is all about.

Unfortunately, I'm afraid too many fellow Americans would answer, "Yes,
some kind of force, fines or imprisonment should be initiated against a person
who refuses to give up his earnings for the use of another." The debate should
be just who has the rights to another's earnings. I'm some would argue that
farmers and dairymen don't have a right to another's earnings, but students and
poor people do. Others would argue the opposite.

A French economist
Frederic Bastiat (1801-1850) said, "Government is the great fiction through
which everybody endeavors to live at the expense of everybody else." That
endeavor has plagued mankind throughout his history and has now reached a crisis
stage in Western Europe and the United States. We call it progressivism,
socialism, not communism or fascism, but prospects for reversal don't appear to
be promising, particularly as long as as we have a Progessive, Socialist,
Democrat Congress, Senate, and Presidency.

Dr. Williams column on Global Warming Farce

Private industry and governments around the world have spent trillions of dollars in the name of saving our planet from manmade global warming. Academic institutions, think tanks and schools have altered their curricula and agenda to accommodate what was seen as the global warming "consensus."

Mounting evidence suggests that claims of manmade global warming might turn out to be the greatest hoax in mankind's history. Immune and hostile to the evidence, President Barack Obama's administration and most of the U.S. Congress sides with Climate Czar Carol Browner, who says, "I'm sticking with the 2,500 scientists. These people have been studying this issue for a very long time and agree this problem is real."

The scientists whom Browner references are associated with the U.N.'s Intergovernmental Panel on Climate Change (IPCC). Let's look some of what they told us. The 2007 IPCC report, which won them a Nobel Peace Prize, said that the probability of Himalayan glaciers "disappearing by the year 2035 and perhaps sooner is very high" as a result of manmade global warming. Recently, IPCC was forced to retract their glacier disappearance claim, which was made on the basis of a non-scientific magazine article. When critics initially questioned the prediction, Rajendra Pachauri, IPCC's chairman, dismissed them as "voodoo scientists."

Sean Hannity FREE

The IPCC also had to retract its claim that up to 40 percent of the Amazonian forests were at risk from global warming and would likely be replaced by "tropical savannas" if temperatures continued to rise. The IPCC claim was based on a paper co-authored by the World Wildlife Fund (WWF) and the International Union for Conservation of Nature (IUCN), two environmental activist groups.

England's now-disgraced University of East Anglia's Climatic Research Unit (CRU) has been a leader in climate research data. Their data, collected and analyzed by them, have been used for years to bolster IPCC efforts to press governments to cut carbon dioxide emissions. Climatologists, including CRU's disgraced former director Professor Phil Jones, have been accused of manipulating data and criminally withholding scientific information to prevent its disclosure under the Freedom of Information Act.

Professor Jones, considered to be the high priest of the manmade global warming movement, has been in the spotlight since he was forced to step down as CRU's director after the leaking of e-mails that skeptics claim show scientists were manipulating data. In a recent interview with the BBC, he admitted that he did not believe that "the debate on climate change is over" and that he didn't "believe the vast majority of climate scientists think this."

Long denied by the warmers, Professor Jones admitted that the Medieval Warm Period (800 A.D. to 1300 A.D.) might well had been as warm as the Current Warm Period (1975-present), or warmer, and that if it was, "then obviously the late-20th century warmth would not be unprecedented." That suggests global warming may not be a manmade phenomenon. In any case, Professor Jones said that for the past 15 years, there has been no "statistically significant" global warming.

During the BBC interview, Professor Jones dodged several questions: why he had asked a colleague to delete e-mails relating to the IPCC's Fourth Assessment Report and ask others to do likewise; whether some of his handling of data had crossed the line of acceptable scientific practice; and what about his letter saying that he had used a "trick" to "hide the decline" in tree-ring temperature data?

Given all the false claims and evidence pointing to scientific fraud, I don't think it wise to continue spending billions of dollars and enacting economically crippling regulations in the name of fighting global warming. At the minimum, we should stop the Environmental Protection Agency from going on with their plans to regulate carbon emissions. Companies should resign from the United States Climate Action Partnership (USCAP), a lobbying group of businesses and radical environmentalists. Dr. Tom Borelli, who is director of the National Center for Public Policy Research's Free Enterprise Project, says that BP, Caterpillar, Conoco Phillips, Marsh, Inc. and Xerox have the common sense to so already.

The 545 People most responsible for America’s Problems

The 545 People most responsible for America’s Problems

Let’s start off with some eternal truths. 1. Politicians are the only people in the world who create problems and then campaign against them. Then they either make them worse or find a way to make sure the cure is worse than the original problem so that the cure also becomes a problem. That way, they can lie about what they’ve been doing to stave off the original problem.

2. Have you ever wondered, if both the Democrats and the Republicans are against deficits, WHY do we have deficits? If the government were run like most businesses, we would have declared bankruptcy long ago and restructured to prevent further deficits. Governments should always break even every year, regardless of its level. To do anything else suggest incompetence on the part of the politicians in charge.

3. Have you ever wondered, if all the politicians are against inflation and high taxes, WHY do we have inflation and high taxes? Because inflation means you have to spend more money for anything thereby requiring politicians to spend more monies on everything to keep the same level of services. This way, they can legitimately ask for more and more of your money.

4. You and I don't propose a federal budget. The president does. And congress authorizes the expenditures and the taxes to pay for them. Remember this always. Governments have no monies nor wealth that they don’t first take from their subjects.

5. You and I don't have the Constitutional authority to vote on appropriations. The House of Representatives does. Then the Senate is supposed to discuss and adjust those appropriations, not rubber stamp them. Of course, Senators are no longer beholden to the State Governments because they’re popularly elected just like their Representative neighbors so they’ve become just another spending body. That’s how elections are won. Buy the votes with their own monies collected through taxes they have no voice in controlling.

6. You and I don't write the tax code, Congress does. Them with the money makes the rules.

7. You and I don't set fiscal policy, Congress does. (occasionally, if the Federal Bank isn’t looking.)

8. You and I don't control monetary policy, the Federal Reserve Bank does. (Well, until Obama was elected, anyway.)

One hundred senators, 435 congressmen, one president, and nine Supreme Court justices equates to 545 human beings out of the 300 million are directly, legally, morally, and individually responsible for the domestic problems that plague this country. I exclude the members of the Federal Reserve Board because that problem was created by Congress. In 1913, Congress delegated its Constitutional duty to provide a sound currency to a federally chartered, but private, central bank. It’s a good job if you can get it.

I also exclude all special interests and lobbyists for the very simple reason they have no legal authority, no ability to coerce a senator, a congressman, or a president to do one cotton-picking thing (except with money, of course.). I don't care if they offer a politician $1 million dollars in cash. Politicians have the power to accept or reject. No matter what the lobbyist promises, it is the legislator's responsibility to determine his votes.

Those 545 human beings spend a lot of their energy (we call it campaigning after they’ve been elected.) convincing you that what they did is not their fault. They cooperate in this common con regardless of party. And some of the media cooperates as well, particularly if they like the politician in question, like Barry Barrack Soetoro Hussein Obama. He is the first near black president, you know…

That separating politicians from normal human beings is an excessive amount of gall. No (intelligent) normal human being would have the gall of a Speaker of the House to stand up and criticize a President for creating deficits.   The president only proposes a budget. He cannot force the Congress to accept it and he doesn’t appropriate monies.

The Constitution, the supreme law of the land, gives sole responsibility to the House of Representatives for originating and approving appropriations and taxes. Who is the speaker of the House? Nancy Pelosi, the leader of the majority party. She and fellow House members, not the president, can approve any budget they want. If the president vetoes it, they can pass it over his veto if they can manage to agree to.

It seems inconceivable to me that a nation of 300 million has not yet replaced a mere 545 people who stand convicted -- by present facts -- of incompetence and irresponsibility.   I can't think of a single domestic problem that is not directly traceable to those 545 people. When you fully grasp the plain truth that 545 people exercise the power of the federal government, then it must follow that what exists is what they want to exist. It would seem self evident.

If the tax code is unfair, it's because they want it unfair. If the budget is in the red, it's because they want it in the red. If the Army & Marines are in IRAQ and Afghanistan, it's because they want them there. If they do not receive social security but are on an elite retirement plan and HEALTH CARE INSURANCE PLAN not available to the people, it's because they want it that way.

There are no insoluble government problems except those Congress wishes to ignore and perpetuate.

Don’t let those 545 people shift the blame to bureaucrats, whom they hire and whose jobs they can abolish; to lobbyists, whose gifts and advice they can reject; to regulators, to whom they give the power to regulate and from whom they can take that power.   Above all, don’t let them con you into the belief that there exists such disembodied ephemeral, mystical forces like "the economy," "inflation," or "politics" that prevent them from doing the things they take an oath to do. Those 545 people, and they alone, are responsible. They, and they alone, have the power. They, and they alone, should be held accountable by the people who are their bosses. Provided the voters have the gumption to manage their own employees. We should vote all of them out of office and clean up their mess! Never vote for an incumbent. Throw’em all out. The very few honest ones will have no trouble finding honest work. The rest can go on welfare.

Diversity is Nothing More than Reverse Discrimination

Diversity is Nothing More than Reverse Discrimination

Walter Williams wrote a recent editorial about the Naval Academy and their Diversity Program. Having experienced this form of discrimination many times while a federal employee, I agree with him wholeheartedly. Here’s how the Naval Academy's PowerPoint display explains diversity by saying, "Diversity is all the different characteristics and attributes of individual sailors and civilians which enhance the mission readiness of the Navy," adding that: "Diversity is more than equal opportunity, race, gender or religion. Diversity is the understanding of how each of us brings different skills, talents and experiences to the fight -- and valuing those differences. Leveraging diversity creates an environment of excellence and continuous improvement to remove artificial achievement barriers and value the contribution of all participants." Admiral Gary Roughead, chief of Naval Operations, says that "diversity is the No. 1 priority" at the academy.” Unfortunately, how diversity is being and is to be achieved completely belies this statement.

Says Walter, “Diversity at the Naval Academy, as at most academic institutions, is not about equal opportunity but a race and sex spoils system to achieve what the Navy brass see as a pleasing race and sex mix. They accomplish that vision by the removal of "artificial achievement barriers." Mr. Williams, a professional, educated black man of real accomplishment, then describes what he sees as the Naval Academy’s artificial achievement barrier candidate, a black with B and C grades, with no particular leadership qualities, and 500 on both portions of the SAT. Such is virtually guaranteed admittance while a white student, who's not an athlete, with such scores is deemed not qualified. In fact, there is a disproportionate number of unqualified blacks now in attendance at 3 service academies.

Many students ( of all minority groups) are admitted to the Naval Academy through remedial training at the Naval Academy Preparatory School (NAPS) in Newport, R.I., which is a one-year post-secondary school. Finishing the year with a 2.0 GPA, a C average, almost guarantees admission to the academy. A C average for remedial work is nothing to write home about. Occasionally, when students don't make the 2.0 GPA target, the target is renegotiated downward. Minority applicants with SAT scores down to the 300s and with Cs and Ds grades (and no particular leadership or athletics) are also admitted after a remedial year at the Naval Academy Preparatory School. “ All the academies have their remedial schools.

But such unqualified applicants who apply for mere government positions not Military Academies are still hired and given promotion preferences over higher qualified non-minorities simply because they exist, even though the Civil Service Law governing “equal opportunity” dictates different methodology for selections than mere color or gender. The Law is ignored in the name of diversity and most promotional selections must first be approved by some “equal opportunity” office or board made up of minorities, generally blacks. This has been going on so long, there is a huge majority disparity of black women who now run virtually every agency in Washington.

Selection boards and officials are under constant pressure to select minorities rather than better qualified and educated whites. They found the way to do this legally is to lower the overall standards for selections by discounting education directly related to the agencies for which they work, equalizing outside work experience with experience gained within each agency, then allowing anyone with an overall score above the actual minimum required to be selected rather than the most qualified. Sometimes the information and selection criteria used become “unavailable” or the selectors are told to NOT write anything down because no records will then be available in case of lawsuits or reviews.

Diversity agendas give rise to widespread resentments at two levels. Some minorities admitted or promoted meritoriously on the same basis as whites, resent the idea of being seen as having the same minimal qualities as blacks given preferential treatment, in other words being ignorant. Another level of resentment comes from whites who see minorities being admitted, retained, and promoted at lower levels of overall performance and achievement then being treated with kid gloves. If any whites openly complain about the unequal treatment, they run the risk of being labeled as racists, one of the most unappreciated aspects of preferential treatment. It runs the risk of creating racist attitudes, and possibly feelings of racial superiority, among whites and others who were formerly racially neutral.

Governments at all levels, Colleges, Universities, and Corporations with racially preferential admittance and promotional policies are doing a great disservice to blacks and other minorities in another, mostly ignored, way. By admitting and promoting poorly prepared and educated blacks and minorities, they are helping to conceal the grossly fraudulent education they receive at the K through 12 grades. Also, ignorance breeds ignorance and bad decisions because the poorly prepared don’t want to compete with more highly qualified so tend to select and promote other poorly qualified minorities with whom they can better compete. And this forces already low standards even lower.

The Obama Heallthcare Plan

The Obama Health Care Plan President Barack Obama's health care plan will spend $1 trillion over the next 10 years.

Obama says government is the best arbiter of health. Why is that? BO's plan insures only 16 million of the supposed 46 million uninsured of our nation. Of course, no one actually knows how many people actually lack health insurance but BO says it so we must accept it, even if wrong? Why is that? As many as 300 million Americans have health insurance (which IS NOT health care) so why should our entire nation be forced into government insured healthcare just to carry the other supposed 46 million?

A quick profile of the uninsured says ten million are illegal immigrants - which doesn't mean they don't get health care, free. Walk into virtually any emergency room in America and illegal immigrants are the bulk of patients. (Education and health care costs for illegal immigrants comprise from 16.4 to 20.5 percent of California's budget deficit. Figures are similar nationwide.)

Liberals (Dem Socialists) are urging Obama's nationalized health care plan cover illegal immigrants. The Washington Post suggests failure to include illegal immigrants in the new National health care redesign would create unemployment among U.S. citizens since businesses wouldn't be forced to pick up the insurance tabs for illegals thus hire them at greater rates. This is likely true unless laws to prosecute businesses that hire illegal immigrants - or, better yet, not to require employers to cover employees – are enacted. Only Socialists would use employer malfeasance as an excuse to sacrifice workers' current insurance plans.

Another 9 million or so "uninsured" have household incomes of above $75,000, more than 3 times federal poverty standards for a family of four. For a mere married couple, that's 7 times federal poverty standard. Some 30% of these people are temporarily without health insurance, normally for six months or less, between jobs. Many others voluntarily avoid health insurance; even if they can afford it (My wife and I did during our youth. So did my kids.)a perfectly reasonable position. Factually, many people worry less about paying for the occasional visit to the doctor than paying monthly premiums. The Obama plan would force insurance on all these people then force public (Government controlled and paid for) insurance on the rest of us. Kindly remember, government has nothing it doesn't first take from us – its citizens – first. The PUBLIC will have to pay for Gov. Insurance through taxes.

Sally Pipes of the Pacific Research Institute and author of The Top Ten Myths of American Health Care says there are "12 million uninsured Americans … eligible for Medicaid and the State Children's Health insurance program -- but they haven't signed up,". Again, voluntary behavior is voluntary, not an excuse for government involvement.

OK, let's sum up. Of those 46 million "uninsured," 31 million uninsured require no fix from the federal government. That leaves 15 million uninsured unaccounted for. The nationalized health care plan Obama proposes, shifts health care insurance for literally 95 percent of the population to a FEDERALLY controlled plan on behalf of 5 percent of our population, the 5 percent who, like illegal immigrants, receive FREE emergency care anytime under current federal law. Why is that?

The media and BO portray the American health system as a system in crisis by pointing to skyrocketing premiums. Costs of a family policy is now approximately $1,000 per month for employers. Obama says, "One out of every five dollars we earn will be spent on health care in a decade." Premiums for family coverage have risen 78 percent since 2001. The current Government programs, Medicare and Medicaid, comprise a huge chunk of the federal budget. In ten years, they'll comprise more than any other government expenditure. You might consider this as well. Social Security is now broke taking in less than it spends each and every month.

Why are these costs rising exponentially higher? Because of current increased government involvement in the health care system. State regulations decrease market flexibility by requiring that insurers cover unhealthy individuals at lower-cost and requiring insurers cover certain hospitals and doctors. Federal and State governments require health care providers (Insurers and medical personnel) care for individuals without reimbursement which means continually escalating costs for those who do pay, the general public and taxpayers. Both federal and state health care subsidization programs encourage health care providers and insurance to raise prices, our costs, to break even. More government equals higher costs, not lower.

The answer should be more free markets, not less. Competition between insurers, not government monopoly, would lower costs. The correct answer is an expanded private system, not a public one paid for by public taxes. There is no single payer system anywhere in the world that gives better care than we get in the USA, now

My Apologies to Mr. Cliton

This is an Open Apology to former President William Jefferson "Blythe" Clinton

Fact is, once upon a time I thought of and often spoke of Willy Boy Clinton and his wife, Hillarious, as the most dishonest, lying, pissant politicians I'd ever known or that had ever dishonored the Oval Office or congress. Honesty requires me to publicly admit I was wrong, dead wrong and I wish to hereby apologize to both the Clintons. The fact is our current President, Barrack H.(Barry Soetoro)O'Bama puts them both to shame as professional liars. They are merely rank amateurs in comparison to our current prevaricator and top only his sycophants amongst congress and the broadcast media for dedication to mendacity.

BO has scarcely made any truthful public statement since the very beginnings of his long presidential campaign. He has prevaricated about his birth circumstances, place, citizenship, education, who raised him, where, his school studies, transcripts, jobs, acquaintances, friends, religion, income, attitudes, intentions, agenda, appointees, efforts, work ethic, promises, the importance of various legislations, how much money he is and intends to spend, present and future deficits, and the overall costs to our nation. Ole Willy is merely a normal dishonest, self-worshipping politician in comparison. Bo's arrogance, narcissism, and dedication to Socialism's "Big Lie" is truly awe inspiring but the ease with which he lies is frankly annoying. The media's worshipful affair with his every proclamation defies rational explanation but they are making careers of enabling him to get away with it all.

Examples are so numerous any sane adult with a pulse must surely be aware of many instances. He has never released an actual birth certificate and college records indicate he receivedfinancial aid as a foreign student from Indonesia as an undergraduate at OCCIDENTAL COLLEGE. Along with evidence he was born in Kenya, there is no record of his ever applying for US citizenship. If he was actually born in Hawaii then he lied to get his education paid for but if actually born in Kenya (as then claimed), he isn't legally president which is why there are numerous (18) pending lawsuits concerning his records. We know he lied about his friends and acquaintances, even his church pastor, why not his birthplace? Of course, Eric Holder, Obama's Attorney General, is the ultimate law enforcement official who must judge whether or not the lawsuits may be pressed or suppressed.

He told us his would be the "most completely honest" administration in history. Many of his appointees are tax evaders forced to pay back taxes (or who could not hold office because of their dishonesty) including his main advisor, Rahm Emmanuel, a long time supporter of wealth redistribution and Timothy Franz Geithner the 75th and current United States Secretary of the Treasury, previously the president of the Federal Reserve Bank of New York. Even his current appointment for the Supreme Court has been proven a lying racist judge whose findings have been many times overturned by Superior Courts. In another instance, when he jammed through the trillion-plus-dollar pork pie, he claimed it was so urgently needed, he couldn't even spare legislators 48 hours to read the 1,100 pages. However, once they passed the bill, Obama still waited four more days before flying off to Denver to sign it during a photo op. Lately, he says the Government hasn't taken over GM nor caused Chrysler to be taken over by Fiat nor does he want government to take over Health Care, Insurance Companies, nor Banks. Right, and the Pope doesn't want to go to Heaven, either.

Really, Mr. Clinton, I'm sorry I ever labeled you the Prevaricator in Chief. It is just that you happened to hold the highest office in the land at that time. But now your every effort has been surpassed with an ease that I find truly awe inspiring. I guess that is why Media people are prostituting themselves so completely. They, too, are in awe of BO and all his accomplishments. After all,in the history of the world, no single person has ever caused a country's more rapid decline and fall into socialism than has BO. He is truly the human pinnacle of deceit. I hope you will accept my heart-felt apology. The worst of luck in your quest to become the Secretary General of the United Nations although, at his present rate, BO may beat you to that as well.

The Obamites Must be Resisted

The Obamites Must be Resisted

Nowhere in the world has socialism succeeded at anything except murder and power at the point of a gun. We dare not call it Communism here but that is always the result of Socialists' centralized power. Obama and his fellow traveling Democrats in Congress are now in the process of grabbing total control of every aspect of American life through the Health Care scheme and the Cap and Trade energy bills. The American freedom of my youth has ceased to exist.

Factually, Congressional mandates through the likes of the amoral Barney Frankus, Chris Dudd, Nancy Pelagrosi, Harry Rader, and that most capable of liars, B.H. Obama, have led to America foundering in debt the likes of which the world has never seen. Debt drowned the Soviet Union. I can't believe we are immune simply because we are the world's largest economy. The lust for power in Congress, particularly the Dems, has led us toward ruin.

Savagery has always been the hallmark of Socialism. In the Ukraine 7 million deaths, tens of thousands in Ethiopia, hundreds of thousands in each Viet Nam, Laos, Cambodia, Kampuchea, Cuba, East Germany, Afghanistan, North Korea, and uncounted millions more in China and Tibet. Please don't say it cannot happen here. The Germans simply did not believe it could happen to them either but their National Socialist Party was responsible for millions of deaths in WWII.

Do my words seem hysterical? Have the words of so many martyrs to Socialism during the past century also been hysterical? The takeovers of every now Socialist country began in similar manners, through the supposed good intentions of their politicians bent on power at any cost. We are not exempt simply because we once loved freedom. Look at New Orleans. Many hundreds died because they expected government to take care of them and thousands more are now endangered for the same reasons; they are no longer able to take care of themselves and expect government to give them everything. One must always remember, no government, especially not republics nor democracies, have anything, money nor power, that it has not taken from the people.

Resisting Obama and his fellow travelers is mere patriotism. The "Tea Party" tax revolts and the increasing numbers of those who attend them are patriotic peaceful resistance but there is but one safe way to regain freedom. Throw all the bums out. Leave no current officeholder in power. Elect an entirely new congress. Yes, there are a few pols who still retain some integrity but they are dismally few in number. Better to be safe than sorry. Run them ALL out. Reduce the once great GOP and DNC parties to nothing. Vote Libertarian, Constitutional Party, or just Independent but don't vote for another party hack. We must start over, NOW, or become slaves. Resistance is patriotic. Passiveness is suicidal.

SCOTUS

The Souter Replacement Battle

Here's the oath Supreme Court justices must take: "I, (name), do solemnly swear (or affirm) that I will administer justice without respect to persons, and do equal right to the poor and to the rich, and that I will faithfully and impartially discharge and perform all the duties incumbent upon me as (title) under the Constitution and laws of the United States. So help me God."

President Obama prefers Supreme Court justices who will violate their oath of office. He hopes Sonia Sotomayor is the right Hispanic woman for the job since he is not looking for someone to fulfill that vow but someone whom he knows willfully violates it. That is what Liberalism requires, judicial activism, not justice.

It is easy to contrast the above oath with BO's insistence that the "quality of empathy, of understanding and identifying with people's hopes and struggles" is the key qualification for a Supreme Court Justice. According to his White House talking points, Judge Sotomayor's "American story" of humble origins -- she was raised in the South Bronx, along with several million other people -- best prepares her for the high court because it shows "she understands upholding the rule of law means going beyond legal theory to ensure consistent, fair, common-sense application of the law to real-world facts." In other words, her rulings should be tainted with her personal feelings rather than actual legal precedent.

Mr. Obama says law and precedent should only determine rulings in "95 percent of the cases" but in the really hard and important cases, justices should go with their heart. "In those cases, adherence to precedent and rules of construction and interpretation will only get you through the 25th mile of the marathon. That last mile can only be determined on the basis of one's deepest values, one's core concerns, one's broader perspectives on how the world works, and the depth and breadth of one's empathy."

Please keep in mind that Supreme Court cases just happen to constitute that 5% and nearly 100 percent of what we argue about as a country. For those hard cases Americans care most about, Obama says empathy should rule, not law. I think that is because liberal Socialists wish to change our country in ways that normal law will not allow but judicial activism can accomplish without legislation. Examples: Homosexual marriage, Equal Opportunity laws that emphasize not equality but favor for minorities, Abortion on demand, Social Security and Healthcare monies spent in non-citizens, etc.

So, what's so wrong with empathy vs. legal precedent? Not much, really. Empathy is fine and good for all decent people to employ, including Supreme Court justices. But it shouldn’t be the basis of all decisions, certainly not the law of the land.

Mr. Obama has something very specific in mind when he talks about empathy. He wants not just the justice's oath to be rewritten but that judges to administer their justice with direct respect to persons. They must be partial, not impartial to whomever they choose and so on.

This is not really open to much debate. When Obama voted against Chief Justice John Roberts' confirmation, he said that Roberts didn't have the "heart" to vote the right way in those 5 percent cases. Rather than Roberts the Cruel, Obama explained, "we need somebody who's got the heart -- the empathy -- to recognize what it's like to be a young teenage mom. The empathy to understand what it's like to be poor or African-American or gay or disabled or old -- and that's the criteria by which I'll be selecting my judges." Cue Sotomayor the Empathic.

The assumed reasoning here is dubious at best. Obama and Sotomayor assume firsthand understanding of the plight of the poor or African-Americans or gays or whatever automatically require justices voting a certain (liberal) way. "I would hope," Sotomayor said in 2001, "that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life."

This is not only deeply offensive, it is also nonsense elevated to astronomic heights. Surely Clarence Thomas understands what it is like to be poor and black better than any other justice currently on the bench. How's that working out for liberals? Why don’t they love him?

Naturally, liberals say anytime you disagree with their policy prescriptions on, say, racial quotas, abortion, or anything else, it's because you just don't care as much as they do about - minorities or women or ... That is why they've aggressively demonized Thomas as a villainous race-traitor which is an arrogantly stupid assumption. But even if it were true, why are we talking about policy preferences and the courts? Policy preferences are the province of Legislatures despite Ms. Sotomayor's insistence that courts are "where policy is made." That is where Socialist WANT policy made since they cannot control all the legislatures in any republic.

Just as importantly, who keeps saying conservatives are against judicial empathy? I think we are all for empathy for the party most deserving of justice before the Supreme Court, within the bounds of the law and Constitution.

When the law (Constitution) means siding with a poor black man, great. If it means siding with a rich white one, that's great too. The same holds for gays, gun owners, single mothers, and immigrants. We should all rejoice when justices actually fulfill their oaths giving everyone fair hearings, even if that's not how Obama and his minions see it.

The Threat at Home

The Threat at Home

by David Horowitz in Townhall.com

My parents were members of the American Communist Party and I was part of the progressive left which was the communist left and which has grown ominously large toda1y, and has seen its candidate elected to the White House. I was the editor of the largest magazine of the new left, which was organized by the children of communists, so-called 'red diaper babies' like myself. We regarded America as the enemy. We began as an isolated political minority, but the hate America crowd has grown alarmingly in size since then. Today, nobody is embarrassed about slandering their own country even in time of war, and this includes our current President who recently apologized for the actions of his country to Latin American communists, Jew-haters and self-declared enemies, such as Venezuela's Chavez and Nicarauguan jefe Daniel Ortega, a degenerate who molested his own daughter.

In Obama's presence Ortega went into a rant against America claiming that our government conducted a "terrorist" war against Nicaragua in the 1980s, when in fact American pressure forced an end to the Sandinista dictatorship and the re-institution of a free press and open elections. What was President Obama's response to the Ortega attack?"Well, I was only six years old at the time." In other words, an apology for our "terrorist" acts against the Marxist dictatorship. This is disgraceful and also dangerous.

To answer your question as to how I arrived at the views I now hold, during the early 1979s I was working with the Black Panther Party whose leaders were the heroes of all progressives, who took them to be the victims of American oppression and police brutality. As I soon discovered, the Panthers were, in fact, criminals and murderers and not the victims the left claimed them to be. In 1974, they killed my friend Betty Van Patter, which brought all this home to me. The left protected the Panther murderers and made apologies for their other criminal deeds. Today, campus progressives invite the killers to their schools and give them ten-thousand-dollar speaking fees to denounce America as a "racist" country and criminal nation, which is what progressives want to hear.

The second principal cause of my change of heart was the Vietnam War. I was one of the leaders of the anti-war movement of the time. Of course, these anti-war movements of the left aren't really anti-war movements in any meaningful sense of the word. They are anti-American movements, designed to make America lose whatever war it is engaged in. If there had been a peace movement during the lead up to the war in Iraq, for example, there would have been at least one demonstration in front of the Iraq Embassy calling on Saddam Hussein to obey the U.N. resolutions and the arms control agreements he had signed. But there wasn't. Not one. The so-called anti-war activists were not demonstrating for peace. They were demonstrating against America and its efforts to hold Saddam to the UN peace agreements he had signed.

During the Vietnam years, the goal of the so-called anti-war movement was to cause America to lose the war-- and that includes every leader of the anti-Vietnam left -- John Kerry, Jane Fonda, Tom Hayden, and so on. The anti-Vietnam movement wanted America to lose because for the left, for progressives, we are the bad guys: America, the oppressor. America did lose the Vietnam as a result of our protests. The anti-American anti-war movement forced America to give up the fight for freedom in Vietnam, to retreat from the field of battle, to withdraw overnight. It was the same prescription that Nancy Pelosi and Harry Reed and the congressional Democrats wanted for Iraq. Fortunately they failed, and consequently Iraq is not ruled by terrorists today

But in Indo-China the ending was different. Once America quit the field of battle, the Communists proceeded to slaughter two-and a-half million poor Vietnamese and Cambodian peasants – one of the worst genocides in history. But there wasn't a single demonstration by progressives against this atrocity. Bloodbaths are okay if they are committed by progressives of color in the name of "social justice."

From communism to Islamo-fascism, the left in America – as elsewhere – has had a lifelong love affair with tyranny and terror, which is the title of an important book that my Frontpage editor Jamie Glazov has just published. It's called: United in Hate, the Left's Love Affair with Tyranny and Terror. That is who they are. Progressives are adept at speaking the language of peace and love and justice; but these words are just a smokescreen for their real agendas which are search and destroy. Anybody who has ever encountered a progressive up close in any kind of political disagreement knows that this is a hate movement. They hate conservatives; they hate Republicans; they hate white males, and increasingly they hate Christians and Jews. They hated George Bush.

How can you hate George Bush? He may have done a lot of things that you wouldn't have done; but how can you hate the man? But they do. They are haters. Their mouths drip with hate. You can't name a single conservative spokesman from Rush Limbaugh to Ann Coulter, to Sarah Palin to, well, George Bush, who hasn't been stigmatized, slandered, demonized, libeled, and trashed as indecent, beneath humanity, contemptible, toxic, and viral. And yet conservatives continue to call such haters … liberals!

It is conservatives who are actually liberal. We believe that there should be two sides to a question and that when people disagree with us they are often mistaken, and not necessarily evil. I have written a book with Jacob Laksin about universities called One Party Classroom. Among other things, the title highlights the fact that so-called liberals have purged American faculties of conservative voices. It has been the most successful witch-hunt in American history. Conservatives are as rare as unicorns on the faculties of American universities and there isn't a liberal in sight who has expressed concern about this deplorable fact or the mentality that makes it possible.

So-called "liberal" professors will assign books on one side of controversial issues – the leftwing side -- and then ram down students' throats the idea that America is a racist, sexist, homophobic, imperialist country, which therefore deserves to be attacked by freedom fighters who are mis-labeled "terrorists." If these terrorists happen to commit an unspeakable act every now then, it's only because they are forced to do it by Jews and crusaders who have left them no alternative. What despicable rot. People have been oppressed for thousands of years without resorting to the evil tactics of Islamic "martyrs." Until the Palestinians there has never been a people so in thrall to a death cult -- so culturally and morally sick -- as to murder their own children by strapping bombs to them and telling them to blow up other little children and, if they are lucky enough to be male, they will be rewarded by Allah with seventy-two virgins. How depraved is that? And yet there is not a single Muslim state that denounces the evil behavior of the Palestinians and their Hamas leaders, while the American left supports them.

The avatars of the next Holocaust – Ahmadinejad, Nasrallah and the terrorists of Hamas -- are far more open than the Nazis in their determination to kill the Jews. Hitler hid the final solution from the German people. He hid the fact that he wanted to exterminate the Jews because he believed the Germans were too civilized a people to support it. But the Iranians and Hamas and Hizbullah -- they shout it from the rooftops to the cheers of the Palestinians and the Muslim world and Daniel Ortega, and American leftists like Noam Chomsky and Ward Churchill and their academic "progressive" friends.

Conservatives need to understand this about progressives. They hate you; their malevolence will destroy you if you give them the chance. Look at the performance of the Democratic Party leadership during the Iraq War. America's armed forces were in the field facing enemy fire. The Democrats had authorized the war that sent them into harm's way. But the minute trouble started – three months after hostilities began -- the Democrats pulled out and went into full attack mode against their own country, against their elected commander-in-chief, accusing America of being the aggressor in the war, a criminal nation, an occupier, and torturer.

And how did they explain their about-face? What reason did they give for first authorizing the war and then conducting a propaganda campaign against it – for first supporting their country and then condemning it, for indicting their own country as an aggressor nation conducting an unnecessary war against a country that posed "no threat." (These were the precise terms that Al Gore used to attack his president and his country in his book The Assault on Reason, which was an apt description of the book itself.)

The Democratic leaders explained their betrayal of a war they had authorized by saying that they were lied to, that the President "manipulated the intelligence" to fool them into supporting the use of force against Saddam Hussein. But this was in itself the most obvious and biggest lie of the war. Democrats sit on all the intelligence committees and have access to every intelligence secret America possesses. How could Bush manipulate the intelligence data that John Kerry had on his desk? The answer is: he couldn't.

The Democrats needed this particular lie, however, because they could not admit the real reason for their betrayal. The real reason that Kerry and his colleagues changed their views on the war had nothing to do with the intelligence data or Iraq. It was because a candidate named Howard Dean, who was running on a platform opposing the war, was about to win the Democratic presidential primary as the war moved into its third month. That was the real and only reason why John Kerry turned against the war and for the second time in his wretched career stabbed America's fighting men and women in the field in the back. For five years while American troops were fighting the terrorists in Iraq, the Democratic leadership conducted a propaganda war against them, showing that they were perfectly willing to risk the lives and safety of our troops for political gains for their party. Shame on them.

You can't conduct a campaign saying that America is the aggressor in a war without encouraging the enemy and increasing his strength. You can't destroy national security programs by leaking them to the New York Times and defending the leaks, without endangering American lives. You can't conduct an open-ended campaign to define America as a criminal nation without sapping Americans' ability to defend themselves in a dangerous world with enemies who believe that murdering Americans is a fast-track to the kingdom of heaven. But that is what progressives and the Democratic leadership have done – and they are same individuals who are running our nation today.

Law vs Morality

Law vs. Moral Values
Thursday, April 30, 2009
By Walter E. Williams

A civilized society’s first line of defense is not the law, police and courts but customs, traditions and moral values.

Behavioral norms, mostly transmitted by example, word of mouth and religious teachings, represent a body of wisdom distilled over the ages through experience and trial and error. They include important thou-shalt-nots such as shalt not murder, shalt not steal, shalt not lie and cheat, but they also include all those courtesies one might call ladylike and gentlemanly conduct.

The failure to fully transmit values and traditions to subsequent generations represents one of the failings of the so-called greatest generation.

Behavior accepted as the norm today would have been seen as despicable yesteryear. There are television debt relief advertisements that promise to help debtors to pay back only half of what they owe. Foul language is spoken by children in front of and sometimes to teachers and other adults.

When I was a youngster, it was unthinkable to use foul language to an adult; it would have meant a smack across the face. Back then, parents and teachers didn’t have child-raising “experts” to tell them that “time out” is a means of discipline. Baby showers are held for unwed mothers. Yesteryear, such an acceptance of illegitimacy would have been unthinkable.

To see men sitting whilst a woman or elderly person was standing on a crowded bus or trolley car used to be unthinkable. It was common decency for a man to give up his seat. Today, in some cities there are ordinances requiring public conveyances to set aside seats posted “Senior Citizen Seating.” Laws have replaced common decency. Years ago, a young lady who allowed a guy to have his hand in her rear pocket as they strolled down the street would have been seen as a "slattern". Children addressing adults by first names was unacceptable.

You might be tempted to charge, “Williams, you’re a prude!” I’d ask you whether high rates of illegitimacy make a positive contribution to a civilized society. If not, how would you propose that illegitimacy be controlled? In years past, it was controlled through social sanctions like disgrace and shunning. Is foul language to or in the presence of teachers conducive to an atmosphere of discipline and respect necessary for effective education? If not, how would you propose it be controlled?

Years ago, simply sassing a teacher would have meant a trip to the vice principal’s office for an attitude adjustment administered with a paddle. Years ago, the lowest of lowdown men would not say the kind of things often said to or in front of women today. Gentlemanly behavior protected women from coarse behavior. Today, we expect sexual harassment laws to restrain coarse behavior.

During the 1940s, my family lived in North Philadelphia’s Richard Allen housing project. Many families didn’t lock doors until late at night, if ever. No one ever thought of installing bars on their windows. Hot, humid summer nights found many people sleeping outside on balconies or lawn chairs.

Starting in the ‘60s and ‘70s, doing the same in some neighborhoods would have been tantamount to committing suicide. Keep in mind that the 1940s and ‘50s were a time of gross racial discrimination, high black poverty and few opportunities compared to today. The fact that black neighborhoods were far more civilized at that time should give pause to the excuses of today that blames today’s pathology on poverty and discrimination.

Policemen and laws can never replace customs, traditions and moral values as a means for regulating human behavior. At best, the police and criminal justice system are the last desperate line of defense for a civilized society. Our increased reliance on laws to regulate behavior is a measure of how uncivilized we’ve become.

Carbon Dioxide

Carbon Dioxide
by Kerby Anderson

While Congress is debating cap-and-trade legislation to deal with climate change, the Environmental Protection Agency weighed in with their ruling that may have a profound impact on the debate. The EPA published what is called an "endangerment finding" stating that carbon dioxide is a dangerous pollutant that threatens the public and therefore must be regulated under the 1970 Clean Air Act.

So what is wrong with that? First, the EPA has granted to itself unprecedented power. This finding gives the agency power to impose taxes and regulations across the economy. This was done without any legislative input from our elected representatives. So it is effectively "taxation without representation." That’s a catchy phrase, I wonder where I’ve heard that before?

Second, the EPA's ruling changes the meaning and intent of the Clean Air Act. Just ask Representative John Dingell (D-MI) who helped write the original act as well as the 1990 revision. He says that the act never was intended to apply to carbon. The major reason for the EPA's action was a ruling two years ago by five Supreme Court justices calling for the EPA to determine if carbon dioxide qualifies as a pollutant.

Finally, someone needs to say the obvious. So I will say it. Carbon dioxide is not a pollutant. It is a trace gas that is essential for all plant life to exist. And since plants and vegetation are at the bottom of the food chain, it's not really a stretch to say that all of life is ultimately dependent upon there being carbon dioxide in the atmosphere.

Perhaps it would be helpful to put a few facts on the table. Has carbon dioxide concentration increased? Yes, in the last 150 years, carbon dioxide concentrations have risen from 280 to nearly 380 parts per million. But it is also worth noting that the oceans emit about 96 percent of all greenhouse gases.

When you look at the scientific facts as well as the legislative history of the Clean Air Act, it is hard to justify the EPA's decision to classify carbon dioxide as a pollutant. I'm Kerby Anderson, and that's my point of view.

Point of View | P.O. Box 30 | Dallas, TX 75221

Editorial Comment from the Blue Eye View: Mr. Anderson is exactly right here when he states CO2 is not a pollutant. Since every green plant in the world uses CO2 for fuel, it is silly to assume nothing can be done about the very slight increases measured in a few specific places. Fact, CO2 has NOT been measured all over the globe and is NOT the same percentage in every measurement. The very reason it is refferred to as a greenhouse gas is that GREENHOUSES all over the world introduce CO2 into thier environments to SPEED plant growth. Want to decrease concentrations, increase plants, all of which give off oxygen. YES, that is right, plant trees, increase agricultural production in preasently barren areas. ANd as a side effect, you will also increase rainfall in those areas. Yup, rainforests are self immulating and self-suppying as they suck water out of the ground, exhale it into the atmosphere (along with oxygen) and saturated air then sends it back as precipitation. Agricultural science has known this for at least 200 years. Of course, agricultural growth isn't part of the Environmentalist Agenda.
I do believe the EPA is now being run by the communist minded Environmental Wackos. See above for evidence.
Vote for adults to be elected into congress, vote the Constitutional Party.

Free Speech vs Fed Election Commission

Free Speech Case: Citizens United (Hillary: the Movie) v. Federal Election Commission

Posted: 05 May 2009 07:05 PM PDT

Bill Smith, ARRA Editor: The Cato Institute has been following the Citizens United v. FEC case, in which the Supreme Court is set to rule on whether an organization can use speech about a political candidate in the days leading up to an election. The Federal Election Commission banned Citizen United from showing a film against Hillary Clinton on a pay-per-view basis shortly before the last year’s election.

The so-called Citizens United case offers the Supreme Court a chance to severely curtail the free speech abuses of the Federal Election Commission. If the government can ban broadcasts under federal law, that else can they ban? Books? Commercials? In the following CATO video, campaign finance law and free speech experts discuss the case, and what it means for the future of free speech. The Supreme Court is set to rule on it in the next few weeks. John Samples, Director of the Cato Institute's Center for Representative Government, Institute for Justice Senior Attorney Steve Simpson and George Mason University law professor Allison Hayward weigh in.

The infringement on free speech is troubling. We will be sure to let you know when the Supreme Court makes their ruling. While we cannot predict the outcome, the very thought that the government could eventually ban books, news print, this blog, and any other form of political commentary is nothing more than overturning the 1st amendment. What part of "Congress shall make no law . . . prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press . . ." does Congress and the Federal Election Commission not understand

Fear of Conservatism

Team O Turns Left on Sanity with "Right-Wing Extremists"
by Diana West

Poll
Did you participate in a Tax Day Tea Party Wednesday?

I've got it.

After reading and rereading the surreal Department of Homeland Security intel report on "right-wing extremism" that clearly designates conservative political dissent as part of the threat, I finally figured out why it all seems so familiar.

First, there's the report's leading villain, the "military veteran" returning from war in Iraq and Afghanistan -- the "potential lone wolf" terrorist with the lethal capabilities. That could raise goose bumps in anyone, right?

Then there are the "white supremacists" well known for their "longstanding exploitation of social issues such as abortion, interracial crime and same-sex marriage." (I don't get the connection either.) According to the government, we just might see a growing movement of similarly pro-life, pro-law-and-order, pro-marriage ... "white supremacists." Enough to make anyone hyperventilate, of course.

And what about the "right-wing extremist" who "adopts the immigration issue as a call to action"? Or the "many right-wing extremists" who "are antagonistic toward the new presidential administration and its perceived" -- perceived? -- "stance on a range of issues" including immigration, expanding government programs and gun control? According to the report, such "right-wing extremists are increasingly galvanized by these concerns and leverage them as drivers for recruitment." Sounds like a GOP voter drive to me. Cue up "Psycho"-strains of shrieking violins.

The fact is, we've seen this cast of characters before -- many times before -- in all of the schlock Hollywood movies that year after year harvest a diseased crop of villains from the American heartland, endlessly returning them to the screen as the "crazed veteran," the "religious zealot" and the anti-immigration "Nazi." These are the stock villains -- all racist, naturally -- who are now similarly demonized in the government's report.

This fantastic worldview that sees the country imperiled by military heroes, traditional values and even border security meshes perfectly with the also-official flip side to such paranoid liberal fantasy: namely, the harmlessness of the Islamic brand of "extremism," which Homeland Security Secretary Janet Napolitano recently renamed, and with a straight face, "man-caused disasters." Hollywood, of course, doesn't touch such "extremism" either, sticking with right-wingers-gone-wild to the very last reel.

But Hollywood-fantasy-turned-Washington-reality isn't simply crummy entertainment. It presents a grave menace to political discourse in this country. "We want to move away from the politics of fear," Napolitano declared last month to explain her new secretary-caused euphemism for Islamic terrorism.

But not too far. That is, Napolitano, who supports the DHS report, is plenty content to deal in the politics of fear -- just not fear of Islam. Fear of conservatism, however, is OK by her.

How to make it stick? The DHS report repeatedly reaches back for inspiration to the 1995 Oklahoma City bombing of a federal building, citing "military veteran" and domestic terrorist Timothy McVeigh, one of 42 million veterans who, not incidentally, have not blown up a federal building, as American Legion chief David Rehbein noted in an outraged letter to Napolitano. But while the DHS report is thin on specifics and devoid of sources, it nonetheless quite helpfully exposes the federal government's outrageous strategy to portray conservatism as "right-wing extremism."

The report defines the term this way: "Right-wing extremism in the United States can be broadly divided into those groups, movements, and adherents that are primarily hate-oriented (based on hatred of particular religious, racial or ethnic groups), and those that are mainly antigovernment, rejecting federal authority in favor of state or local authority, or rejecting government authority entirely. It may include groups and individuals that are dedicated to a single issue, such as opposition to abortion or immigration."

Presto -- the federal government has just taken key conservative positions, from opposition to Islamic law to support for security along our Mexican border, and cast them as primitive, "primarily hate-oriented" pathologies that are therefore beyond civilized political discourse. So, too, is opposition to overweening federal powers and "single-issue" opposition to abortion. What we are seeing, in other words, is the most extraordinary governmental attempt in history to limit the spectrum of debate by demonizing a range of positions as "right-wing extremism." This attempt is surely not only unconstitutional but also un-American.

But not in the Obama era. This is a time when the following statement would surely set off a red alert with all federal, state, local and tribal law enforcement authorities who received Homeland's report:

"What we have to do is bring back the recognition that the people of this country can solve its problems. I still believe the answer to any problem lies with the people. I believe in state's rights and I believe in people doing as much as they can for themselves at the community level and at the private level. I believe we have distorted the balance of our government today by giving powers that were never intended to be given in the Constitution to that federal establishment."

In the language of Homeland Security, which "right-wing extremist" preparing for "right-wing radicalization and recruitment" said that?

Ronald Reagan.

The Road to Hellis Paved with Good Intentions

The Road to Hell is Paved with Good Intentions

Have you ever given thought to how we got into our present fascist quagmire? What has brought us to the brink of Socialism where a President can openly fire the CEO of a private corporation and nearly 40% of our nation’s residents receive some form of federal monetary aid (notice I said residents, not citizens.) When did we step onto that slippery slope? And how can we get off?

“It is hard for those who did not live through it to grasp the full force of the worldwide depression. Between 1930 and 1939 U.S. unemployment averaged (editorial note: substitute peaked) 18.2 percent. The economy's output of goods and services (gross national product) declined 30 percent between 1929 and 1933 and recovered to the 1929 level only in 1939. (Ed. Note: The stock market recovered much sooner but GOVERNMENTAL POLICIES stymied recovery.) Prices of almost everything (farm products, raw materials, industrial goods, stocks) fell dramatically. Farm prices, for instance, dropped 51 percent from 1929 to 1933. World trade shriveled: between 1929 and 1933 it shrank 65 percent in dollar value and 25 percent in unit volume. (Ed. Note: Protectionist policies restricting free trade kept business, manufacturing, and agriculture from exporting goods, hence prices and production suffered.) Most nations suffered. In 1932 Britain's unemployment was 17.6 percent. Germany's depression hastened the rise of Hitler and, thereby, contributed to World War II.”        --     Robert Samuelson, Encyclopedia Britannica

Mr. Samuelson’s history is generally accurate but relies upon Marxist economic theory for his commentary, normal in today’s Socialist theology.

In his effort to combat the problems of the Great Depression, Franklin D. Roosevelt proposed, and with the help of the Socialist minded Democratic-controlled Congress passed, many New Deal programs. Within 100 days of taking office in 1933, he and his advisors proposed a series of measures designed to provide relief for the unemployed, recovery of the economy, and reform of the economic and banking systems. In other words, Roosevelt began tinkering with our economic engine. By 1934, the Supreme Court began ruling, correctly, against many of the New Deal programs as unconstitutional. In his second term, Roosevelt, flush from his 1936 landside presidential victory, was outraged and was convinced he had a mandate from the people to continue and expand his New Deal programs. This conflict between the Court and the Executive branches of government led to FDR's court-packing bill in 1937. The court acquiesced joining FDR in his Utopian ideology.

FDR’s Dem Congress passed the Agricultural Adjustment Act of 1933. Portions of its provisions were correctly ruled unconstitutional by the Court in 1933 which lead to passage of further curative amendments by Congress in the Soil Conservation and Domestic Allotment Act in 1936. The Agricultural Adjustment Act of 1938 limited the area that farmers could devote to wheat production. (The Soviets had done so well with their own allocation programs we had to as well. Of course, the USSR allowed 30 million peasants to starve to death so Stalin could eat well, a mere statistic.)

The stated purpose of the act was to stabilize the price of wheat in the national market by controlling the amount of wheat produced. The motivation behind the Act was a belief by Congress that great international fluctuations in the supply and demand for wheat were leading to wide swings in the price of wheat. Of course, our farmers weren’t allowed to export their excesses which led to widespread world hunger and poorer US farmers. Ah, how well the road is paved, eh! Even farmers who grew more than their Government allowed allocations for their own usage were penalized. More Socialism. Why should Government in any form be allowed to tell farmers how much grain they can grow for their own use?

Wickard v. Filburn was a US Supreme Court decision. It allowed the Fed’s to control wheat production. Filburn was a small farmer in Ohio. He was given a wheat acreage allotment of 11.1 acres under a directive, Agricultural Adjustment Act of 1938, which authorized the government to set production quotas for wheat. Filburn harvested nearly 12 acres of wheat above his allotment. He claimed that he wanted the wheat for use on his farm, including feed for his poultry and livestock. Fiburn was penalized. He argued that the excess wheat was unrelated to commerce since he grew it for his own use. It wasn’t sold nor intended to be sold.

The Federal District Court ruled in favor of Filburn. The Act required an affirmative vote of farmers by plebiscite in order to implement the quota. (The Dems thought a vote would seem democratic.) Much of the District Court decision related to the way in which the Secretary of Agriculture had campaigned for passage: The District Court had held that the Secretary's comments were improper. The government then appealed to the Supreme Court of the United States, which called District Court's holding against the campaign methods which led to passage of the quota by farmers a "manifest error." The court then went on to uphold the AAA under the Interstate Commerce Clause.

Government prosecutors claimed concern lest the Act be held to be a regulation of production or consumption rather than of marketing.  In fact, activities such as 'production,' 'manufacturing,' and 'mining' were considered strictly 'local' except in special circumstances and not regulated under the commerce power because their effects upon interstate commerce were, as matter of law, only 'indirect.'

It was supposed no decision of the Court allowed activities to be regulated where no part of the product is intended for interstate commerce or intermingled with the subjects thereof. It doesn’t work that way, of course. The issue was not how one characterized the activity as local, but rather whether the activity "exerts a substantial economic effect on interstate commerce." In simple language, since Filburn didn’t have to buy feed from somebody else, his activities infringed on someone else’s ability to sell their grain.

But the decision held ….even if (a person’s) activity be local and though it may not be regarded as commerce, it may still, whatever its nature, be reached by Congress if it exerts a substantial economic effect on interstate commerce and this irrespective of whether such effect is what might at some earlier time have been defined as 'direct' or 'indirect.'  …..  It was a power grab by FDR and the DEMS to allow them to regulate who could buy and sell. Lot’s of flowery language but same result, Fascism. Just exactly the governmental form we went to war to end in Japan and Europe, aided, abetted, and promoted by a populist President same as Obama today.
